Charles city council chose Chris Kyle to fill the Ward 1 seat over incumbent Bill Otto in a random draw. 
Kyle and four other council members were sworn in at the Tuesday night city council meeting. 
Unofficial final results on election night showed Kyle one vote ahead of Otto. 
But after provisional votes were counted, it was a tie. 
Otto filed for a recount Monday and asked the council to delay the random draw until a judge approves his request for a recount. 
The motion was not seconded and died on the floor. 
“We could have the hand count completed by the next council meeting,” Otto said. 
“If we certify these election results today and declare a winner, and that person loses a hand count, council will have to figure out how to unravel this mess.” 
City spokesperson Jamie Newell said the city’s charter mandates that election results are finalized at the first council meeting after they are received. 
“The city will follow the charter and certify all results at tonight’s meeting,” Jamie said in a statement Tuesday. 
“A lawsuit does not change that process unless a court issues an order directing otherwise.” 
A motion to move forward with the draw was seconded by every council member except Otto. 
Departing Ward 4 council member Mary West, who lost to Scott Shipman in this month’s election, was absent. 
Council President Michael Galba of Ward 8 acknowledged the situation was unusual and challenging at the beginning of the meeting. 
“Transparency, fairness and adherence to the city charter are essential to maintain the integrity of our elections and the trust of our residents,” Galba said. 
“We appreciate the professionalism, patience and respect shown by the candidates and all involved as we work through this process in a transparent and orderly manner.”

Charles County Elections Director Kurt Bahr previously told STLPR the winner of a court-ordered recount would take the contested council seat regardless of the results of the random draw. 
Bahr said a recount is a normal part of the election process and would likely take around four to six hours once approved. 
The hearing to decide whether to approve a recount is scheduled for May 1.
